Mood First Productivity™ · Effective October 13, 2026

These Terms govern your use of the Mood First Productivity™ app (the App). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. What the App does

Mood First Productivity™ is a personal wellness and reflection app. It helps you check in on your mood, energy, and emotions, and suggests work that fits your state. It offers reminders you can set or turn off, and a history of your check-ins. The App is provided for personal wellness, reflection, and self-awareness only.

2. Eligibility

You must be at least 18 years old to use the App. Users aged 13 to 17 may use the App only with a parent or guardian's consent. The App is not intended for children under 13.

3. Medical disclaimer

The App is not a medical device, healthcare service, or diagnostic tool. It does not provide medical, psychological, or therapeutic advice. It is not intended to diagnose, treat, cure, or prevent any condition, does not replace professional mental health treatment, and should not be relied on for medical decisions.

If you experience thoughts of self-harm, suicidal ideation, or a mental health crisis, call or text 988 (Suicide & Crisis Lifeline, US), find a helpline at findahelpline.com, or call 911 immediately.

4. Your data

Your check-ins are stored only on your device. You own everything you enter. We do not receive, store, or process it. Deleting the App deletes your data; you can also delete all check-ins in the App under Settings.

5. Using the App

You agree to use the App only for lawful, personal purposes, and not to reverse engineer, modify, or disrupt it.

6. Intellectual property

All content in the App, including text, design, software, graphics, recommendations, trademarks, and logos, belongs to us or is licensed to us. Mood First Productivity™ is our trademark. You may not copy, modify, distribute, or create derivative works from the App, or use our trademarks without written permission.

7. Changes and availability

We may update, change, or discontinue features of the App. We do not guarantee uninterrupted availability.

8. Limitation of liability

To the maximum extent permitted by law, the App is provided as is and as available, without warranties of any kind. We are not liable for indirect, incidental, consequential, or punitive damages, for decisions made based on the App's suggestions, or for data loss caused by device failure, accidental deletion, or technical issues.

9. Governing law and disputes

These Terms are governed by the laws of the State of Florida and the United States. Disputes will be resolved first through good faith negotiation, then by binding arbitration under the rules of the American Arbitration Association, held in Broward County, Florida or online. Class actions and jury trials are waived.

10. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the App. We may update these Terms; the date above shows the latest version.
